Welcome to LadyData. These Terms of Service ("Terms") govern your access to and use of the LadyData mobile application ("App," "Service," "we," "us," or "our"). By creating an account or using our App, you agree to be bound by these Terms.

IMPORTANT: Please read these Terms carefully before using LadyData. If you do not agree to these Terms, do not use our App.

1. Medical Disclaimer

LadyData is NOT a medical device and is NOT intended for use as a contraceptive method or for medical diagnosis.

Educational Purpose Only:

  • This App is designed for fertility awareness and educational purposes
  • It is NOT a substitute for professional medical advice, diagnosis, or treatment
  • It should NOT be relied upon as your sole method of contraception
  • It does NOT replace consultation with qualified healthcare professionals

Seek Professional Medical Advice:

  • Always consult your doctor, midwife, or qualified healthcare provider before making medical decisions
  • Never disregard professional medical advice or delay seeking it because of information from this App
  • If you have a medical emergency, call emergency services immediately

Accuracy and Reliability:

  • While we strive for accuracy, we make no warranties about the accuracy, completeness, or reliability of fertility predictions or cycle calculations
  • Individual fertility patterns vary significantly
  • Predictions are estimates based on your input data and statistical averages
  • Do not rely solely on App predictions for family planning decisions

2. Acceptance of Terms

By accessing or using LadyData, you acknowledge that you have:

  • Read, understood, and agree to be bound by these Terms
  • Read and agree to our Privacy Policy
  • Confirmed you meet the minimum age requirements (see Section 3)
  • Understood the limitations and medical disclaimers stated herein

We reserve the right to modify these Terms at any time. Continued use of the App after changes constitutes acceptance of the revised Terms.

3. Eligibility and Age Requirements

Minimum Age:

  • You must be at least 17 years old to use this App
  • Users aged 13-16 may use the App only with parental or guardian consent
  • For users in the European Economic Area, you must be at least 16 years old

Account Registration:

  • You must provide accurate, current, and complete information during registration
  • You are responsible for maintaining the confidentiality of your account credentials
  • You must notify us immediately of any unauthorized use of your account
  • One account per person; multiple accounts are prohibited

4. User Responsibilities

You agree to:

  • Use the App in compliance with all applicable laws and regulations
  • Provide accurate health data for reliable tracking and predictions
  • Keep your login credentials secure and confidential
  • Not share your account with others
  • Not attempt to reverse engineer, decompile, or hack the App
  • Not use the App for any unlawful, harmful, or fraudulent purpose
  • Not transmit viruses, malware, or harmful code through the App
  • Not impersonate others or misrepresent your identity

You agree NOT to:

  • Use the App in any way that could damage, disable, or impair our servers
  • Attempt to gain unauthorized access to any part of the App
  • Use automated systems (bots, scrapers) to access the App
  • Copy, modify, or distribute any part of the App without permission
  • Remove or alter any copyright, trademark, or proprietary notices
  • Use the App to harass, abuse, or harm others

5. Account Termination

Your Right to Terminate:

  • You may delete your account at any time through the App settings
  • Account deletion will permanently erase all your data within 30 days
  • Deletion is irreversible; we cannot recover your data once deleted

Our Right to Terminate: We reserve the right to suspend or terminate your account if you:

  • Violate these Terms of Service
  • Engage in fraudulent or illegal activities
  • Threaten the security or integrity of the App
  • Harass or harm other users
  • Attempt to exploit or abuse the App's features

We will provide notice before termination when reasonably possible, except in cases of serious violations or legal requirements.

6. Intellectual Property Rights

Our Ownership:

  • LadyData and all related trademarks, logos, and service marks are owned by us
  • All content, features, and functionality (including design, code, text, graphics) are our exclusive property
  • The App is protected by copyright, trademark, and other intellectual property laws

Your Content:

  • You retain all rights to the health data and content you input into the App
  • By using the App, you grant us a limited license to process your data solely to provide our services
  • We will not use your health data for purposes beyond providing App functionality (see Privacy Policy)

Limited License: We grant you a limited, non-exclusive, non-transferable, revocable license to use the App for personal, non-commercial purposes in accordance with these Terms.

7. Limitation of Liability

DISCLAIMER OF WARRANTIES

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:

  • IMPLIED WARRANTIES OF MERCHANTABILITY
  • FITNESS FOR A PARTICULAR PURPOSE
  • NON-INFRINGEMENT
  • ACCURACY OR RELIABILITY OF INFORMATION
  • UNINTERRUPTED OR ERROR-FREE OPERATION

We do not warrant that:

  • The App will meet your specific requirements
  • The App will be available at all times without interruption
  • All errors or defects will be corrected
  • The App is free from viruses or harmful components
  • Fertility predictions or cycle calculations will be accurate

LIMITATION OF LIABILITY

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE SHALL NOT BE LIABLE FOR ANY:

  • INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES
  • LOSS OF PROFITS, REVENUE, DATA, OR USE
  • PERSONAL INJURY OR PROPERTY DAMAGE
  • PREGNANCY (WANTED OR UNWANTED)
  • FAILURE TO CONCEIVE
  • MEDICAL COMPLICATIONS
  • EMOTIONAL DISTRESS

This limitation applies regardless of the legal theory (contract, tort, negligence, strict liability, or otherwise) and even if we have been advised of the possibility of such damages.

IN NO EVENT SHALL OUR TOTAL LIABILITY EXCEED THE AMOUNT YOU PAID TO US IN THE TWELVE (12) MONTHS PRIOR TO THE EVENT GIVING RISE TO LIABILITY. IF YOU HAVE NOT PAID US ANY FEES, OUR LIABILITY IS LIMITED TO $100 USD.

8. Indemnification

You agree to indemnify, defend, and hold harmless LadyData, its affiliates, officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, costs, or expenses (including reasonable attorneys' fees) arising from:

  • Your use or misuse of the App
  • Your violation of these Terms
  • Your violation of any third-party rights
  • Your violation of any applicable laws or regulations
  • Any false, inaccurate, or misleading information you provide

9. Third-Party Services

Service Providers: Our App uses third-party services for hosting, authentication, and data storage:

  • Supabase (database and authentication)
  • Expo (app development platform)

We are not responsible for the availability, functionality, or privacy practices of these third-party services. Your use of the App constitutes acceptance of these third parties' terms and policies.

No Other Integrations: We do not integrate with social media platforms, advertising networks, or other third-party apps without your explicit consent.

10. Data Backup and Loss

Your Responsibility:

  • You are responsible for regularly exporting and backing up your data
  • Use the data export feature in App settings to save a copy of your information
  • We recommend exporting your data monthly

Our Limitations: While we implement robust backup systems, we are not liable for:

  • Data loss due to technical failures
  • Data corruption from device or network issues
  • Loss of access to your account
  • Accidental deletion of data by you

11. Privacy and Data Protection

Your privacy is important to us. Our collection, use, and protection of your personal and health data is governed by our Privacy Policy, which is incorporated into these Terms by reference.

Key points:

  • We do NOT sell your data to third parties
  • We do NOT share your health data with advertisers
  • Your data is encrypted in transit and at rest
  • You have the right to access, correct, and delete your data
  • Data is permanently deleted within 30 days of account deletion

12. Changes to the Service

We reserve the right to:

  • Modify, suspend, or discontinue any feature of the App at any time
  • Change pricing (with advance notice if fees are introduced)
  • Impose limits on storage, features, or usage
  • Update the App's design, functionality, or user interface

We will make reasonable efforts to notify you of significant changes. Continued use after changes constitutes acceptance.

13. Governing Law and Dispute Resolution

Governing Law: These Terms are governed by the laws of [Your Jurisdiction], without regard to conflict of law principles.

Dispute Resolution:

  • Before filing a lawsuit, you agree to attempt to resolve disputes informally by contacting us at meg@ladydata.co
  • We will attempt to resolve disputes in good faith within 30 days
  • If informal resolution fails, disputes will be resolved through binding arbitration (where legally permissible)
  • Class action lawsuits and class arbitrations are not permitted

Exceptions: Either party may seek injunctive relief in court to protect intellectual property rights or enforce confidentiality obligations.

14. Severability and Waiver

Severability: If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will remain in full effect.

Waiver: Our failure to enforce any right or provision of these Terms will not constitute a waiver of that right or provision.

15. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and LadyData regarding your use of the App and supersede all prior agreements and understandings.

17. Acknowledgment

By using LadyData, you acknowledge that you have read these Terms of Service, understand them, and agree to be bound by them. You also acknowledge that:

  • You understand LadyData is NOT a medical device
  • You will NOT rely solely on LadyData for contraception
  • You will consult healthcare professionals for medical advice
  • You accept the limitations and disclaimers stated herein
  • You are using the App at your own risk

IF YOU DO NOT AGREE TO THESE TERMS, YOU MUST NOT USE THE APP.
